We are constantly updating our Service offering. However, we may experience delays in updating information on the Service and in our advertising on other websites. As a result, the information found on the Service may contain errors or inaccuracies and may not be complete or current. Termination
We may terminate or suspend access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate the Service, you may simply discontinue using the Service.
All provisions of the Terms which by their nature shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Indemnification
You agree to defend, indemnify, and hold harmless RXDC, LP, and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
Limitation of Liability
In no event shall RXDC, LP, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third-party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Disclaimers
This prescription drug discount program is NOT insurance and is NOT intended to replace insurance coverage, and may be discontinued or modified at any time. Void where prohibited. Discounts are not guaranteed, if any, but are exclusively available only at participating pharmacies and may vary depending on brand or generic selection and by pharmacy provider.
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
RXDC, LP, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
Exclusions
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Texas, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
Changes
At our sole discretion, we reserve the right to modify or replace these Terms at any time.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Service.
Additional Terms regarding the Prescription Drug Discount Program
You may print or download a Card without registering with us or creating an account. You may also have received a Card from a third-party sponsoring organization, with or without having provided that third-party with your name or other identifying information. If you request to have a card emailed, texted, or mailed to your home address, you will be required to provide us with your name, email address, home address, and/or telephone number. The information that you provide will be used as set forth in these Terms and our Privacy Policy.
myRxMedSaver or one or more of its affiliates offers access to pharmacy and other related messages via periodic automated SMS (Short Message Service), MMS (Multimedia Message Service) text alerts and email alerts. Enrollment in text alerts requires you to provide your own mobile phone number with an area code within the United States. Enrollment in email alerts requires you to provide an email address. By enrolling to receive myRxMedSaver text or email alerts, you agree to these Terms, which become effective upon your enrollment. You may be asked to verify your mobile phone number before the alerts will start. This requires responding to a text alert sent to your mobile phone confirming your enrollment. You are not required to agree to such messages as a condition of purchasing any goods or services from myRxMedSaver.
You acknowledge that periodic automated alerts will be sent to the mobile phone number or email address you provide to myRxMedSaver. Such alerts may include personal information about your prescriptions based on the type of information you choose to receive via electronic communication, and whoever has access to the mobile phone or carrier account or email address will also be able to see this information. You acknowledge that if you elect to receive Protected Health Information as defined in HIPAA in the form of full prescription information via text alerts or email alerts, you are (i) electing to receive such information through an unencrypted method of communication, and that (ii) information contained in an unencrypted email and/or text message is at risk of being intercepted and read by, or disclosed to, unauthorized third parties. Once you enroll, the frequency of text or email alerts we send to you will vary. You will typically receive alerts when we have information for you about your prescriptions or other healthcare information. myRxMedSaver does not impose a separate charge for text alerts; however, your mobile carrier’s message and data rates may apply depending on the terms and conditions of your mobile phone contract. You are solely responsible for all message and data charges that you incur. Please contact your mobile service provider about such charges.
You may opt out of myRxMedSaver text or email alerts at any time. To stop receiving email alerts, click the “Unsubscribe” link found at the bottom of the email alert or send an email to info@myrxmedsaver.com and request to be opted-out of future email alerts. To stop receiving text alerts, text STOP to the number from which you are receiving text alerts, or you may opt out using other reasonable means. Texting STOP to the number from which you are receiving myRxMedSaver alerts will opt you out of any and all future myRxMedSaver text messages. After you submit a request to unsubscribe, you will receive one final text alert from myRxMedSaver confirming that you will no longer receive text alerts. No additional text alerts will be sent unless you reactivate your enrollment in the text alert program.
The myRxMedSaver text alert programs are offered on an “as is” basis and: (1) may not be available in all areas at all times; and (2) may not continue to work in the event of product, software, coverage or other service changes made by your wireless carrier. myRxMedSaver may change or discontinue any of its text alert programs without notice or liability to you. myRxMedSaver and its related companies and each of their respective officers, directors and employees are not responsible and shall not be liable for any losses or injuries of any kind resulting, directly or indirectly, from any myRxMedSaver text alert program or from technical failures or delays of any kind. myRxMedSaver reserves the right to cease delivery of text alerts to any person at any time in its sole discretion.
